The tragic death of Enoch Mpianzi has sent shockwaves throughout South Africa. In interviews with Netwerk24 and Kyknet Aktueel, Ulrich Roux confirms that a school cannot simply rely on a signed consent form to avoid liability when a child dies whilst participating in official school activities. Furthermore, in the event that negligence and/or recklessness is proven, the school and/or the teachers present could face criminal charges and civil liability.
